I.Initial provisions

  1. The operator and maintainer of the ebszkiallitas.hu, internet site regulated by the Hungarian Building Machine Dealer and Leasing Association (EBSZ) (data handling administration identity, hereafter: Data Handler) respects the constitutional civil rights of each individual, according to which, everyone is free to decide in the question of disclosing and using of one’s personal data. The ebszkiallitas.hu domain includes the Hungarian Building Machine Dealer and Leasing Association (EBSZ), as data handler, for the purpose of the present Data protection regulations.
  2. For the protection of personal data the regulations of data handling – the LXIII./1992 act of the protection of personal data and the publicity of questions of common interest, and also the CXIX/1995 act of research and handling of name and address data for direct business purpose, and the VI./1998. act (of the protection of individuals during the electronic processing of personal data, an agreement announced on 28th, January, 1981, in Strasbourg), the CVIII. act of electronic marketing services and the questions of other services in connection with informational society, and the relevant Hungarian acts referring to data handling-, and also taking into consideration the data protection practice of the data security officer - are determined according to the followings.
  3. The ebszkiallitas.hu respects the regulations referring to privacy of correspondence. "Personal data" denotes information relating to the personal or material circumstances of any natural person, such as for example the name, address, identity number or email address of the said natural person, which are not considered as data of common interest or public information.

II. General principles applied to processing of personal data

  1. The aim of data handling:

Data Handler handles personal data exclusively with the aims of

  1. practising and fulfilling its rights and obligations based on contracts or rules of law against exhibitor or visitor customers. Providing and controlling the required standard of service by considering advertising customers or readers (hereafter: User or Affected).
  2. undertaking market research and direct marketing in connection with the related persons.
  3. updating the already registered data at the Data Handler for further contact.

  1. The scope of the processed data:

Registration is required for particular parts of services offered at www.ebszkiallitas.hu. For registration the following personal data are requested: family name, first name, e-mail address, telephone, fax, mobile number, name and address of workplace, and the job title. The Data Handler processes the following personal data given by the user: family name, first name, e-mail address, telephone, fax, mobile number, name and address of workplace, and the job title.

Data Handler processes personal data during the existence of the objectives of data handling. Personal data shall be deleted upon request of the individual and also when the objectives of data handling are no longer valid.

  1. The rights of the Affected person

The Data Handler provides information about the handled data, the aims, the claim and the term of data handling, the name, address and activity of data processing, and also who and with what purpose do they or did they get the data. The Affected person has the right to initiate amendments in respect of his/her personal data (by providing the correct data), furthermore to ask the deletion of his/her personal data (to withdraw his/her consent). The Data Handler completes the amendments in its database, about which the Affected person shall be informed. The said consent may be revoked by the users at any time, without offering an explanation, partially or completely, except for data required for the rule of data handling and the fulfillment of the obligations determined in the contract signed with the Affected person. The data Handler after the receiving notifiaction about the withdrawal of consent immediately arranges the termination of the data handling, deletes the withdrawn personal data from the database definitively, orders the data administrator and also the oder involved persons of forwarding to delete the data, and finally informs the Affected person about the completion of all the mentioned tasks.
  3. The Affected person may apply for legal appeal in case of infringement of the rights in connection with personal data. The user or reader, who feels that his/her right of protection of personal data, may apply to civil jurisdiction, or may ask the assistance of the data security officer. The detailed legal provisions of the obligations of Data Handler are included in the LXIII/1992 act of the protection of personal data and the publicity of data of common interest.
  4. The affected user acknowledges that his/her family and first names provided by him/her, and also his/her identity code can be found in the heading of all the e-mails sent by the system.

  1. Responsibility

The www.ebszkiallitas.hu assumes no responsibility for information provided by the user. In case ebszkiallitas.hu gets to know that the User violates the right of a third person or law regulations, or causes damages by the failure of abiding by the current data protection rules, ebszkiallitas.hu has the right to take the necessary legal steps in order to reimburse the caused damage and to hold the user, who violated the regulations, responsible. Under no circumstances will the Data Handler disclose or relay personal user data to any third parties. However, this is not applied to obligatory and regulated data forwarding, which may occur only in extraordinary cases. The Data Handler observes previously all offical data forwarding processes, in order to get convinced about the legality of data forwarding. The www.ebszkiallitas.hu cooperates with authorities dealing with such cases.

  1. The person in charge of data administration

The Data Handler has the right to employ people for data administartion services. The person in charge of data administration is obliged to accomplish his/her task according to the assignment, the present regulations and the related legal provisions. The Data Handler bears responsibility for the damage caused by the data administartor against the affected user. The Data Handler informs the data administrator about the amendments and changes in handling of the processed personal data.

  1. Data security

The Data Handler takes all reasonable steps in order to provide the security of data handling, and to create and operate all the required data processing system.
The Data Handler ensures that the processed data shall not be received, published, forwarded, or also modified or deleted by an unauthorised person. The processed data shall be disclosed exclusively to the Data Handler, and the authorised employees of data administration, and www.ebszkiallitas.hu shall not forward it to any unauthorised third person. The storage of data is partly on a Hungarian server system. The Data Handler assumes obligation for ensuring data security with the most modern and most suitable equipment and safety regulations, with special attention of not allowing the data to be held by unauthorised people, for not illegally publishing, deleting or destroying the data. The Data Handler takes all steps in order not to damage or destroy data accidentially. The above obligations are required for all employees participating in the data handling by the Data Handler. Under no circumstance can the Data Handler collect special personal data, such as data referring to racial characteristics, the affiliation to national and ethnical minorities, political and party affiliation, religious belief, safeguarding membership, health status, pathological addiction, sexual orientation or also anything related to criminal records. In case the Data Handler notes that special data –determined by the regulations of Data protecting act- had been entered into the database by any User, the Data Handler has the right to delete it immediately and also to delete the registration of such user. The Data Handler claims that all companies being in partnership with it assume obligation within the contractual regulations for the legal handling of data found in their database. The Data Handler also claims that –beyond the provisions of their contracts- it has no influence on authorised companies over the keeping of the regulations of the protection of personal data. The Data Handler bears no responsibility for the legal data processing and online data forwarding of companies being in partnership with it.

  1. Market research and direct marketing

The Data Handler informs the affected person at the undertaking of market research and direct marketing about the source of obtaining his/her personal data, the aims, ways and term of their usage, the contributor it may use, and also about its intention of later data forwarding, and also about the fact that data providing is voluntary and the termination of data processing may be required at any time.
The Data Handler keeps on separate and non-connectable lists the personal data of those affected people who gave their consent to data handling exclusively for market research or direct marketing. The Data Handler revises the available database frequently.

The Hungarian Building Machine Dealer and Leasing Association (EBSZ) uses the service of a third party by the so-called ’cookies’ with the aim of data collection for its website, www.ebszkiallitas.hu .The data administrator accomplishes its task according to the effective rules of law and to the regulations of the Data protection Regulation of ebszkiallitas.hu. The User by the employing of the services of ebszkiallitas.hu gives its consent to the forwarding of his/her personal data to the data administrator.

III. Validity

  1. The effect of present Regulation is extended to Data Handler –all its employees included- and to all data obtained and processed during its activity.
